STATE OF NEW YORK ________________________________________________________________________ 136 2021-2022 Regular Sessions IN SENATE (Prefiled) January 6, 2021 ___________ Introduced by Sens. MAYER, COMRIE, HARCKHAM, HOYLMAN, SALAZAR -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommunications AN ACT to amend the public service law, in relation to increasing penal- ties for certain violations committed by combination gas and electric corporations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (a) of subdivision 5 of section 25-a of the 2 public service law, as added by section 2 of part X of chapter 57 of the 3 laws of 2013, is amended to read as follows: 4 (a) five hundred thousand dollars or [four one-hundredths] two-tenths 5 of one percent of the annual intrastate gross operating revenue of the 6 corporation, not including taxes paid to and revenues collected on 7 behalf of government entities, whichever is greater, constituting a 8 civil penalty for each separate and distinct offense; provided, however, 9 that for purposes of this paragraph each day of a continuing violation 10 shall not be deemed a separate and distinct offense. The total period of 11 a continuing violation, as well as every distinct violation shall be 12 similarly treated as a separate and distinct offense for purposes of 13 this paragraph; or 14 § 2.
