PARKER, BENJAMIN, CARLUCCI, METZGER -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommunications -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to amend the public service law, in relation to commercial mobile radio and cellular telephone service providers The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 6 of section 5 of the public service law is 2 amended by adding a new paragraph c to read as follows: 3 c. Notwithstanding paragraph a of this subdivision, the commission may 4 designate any commercial mobile radio or cellular telephone service 5 providers as an eligible telecommunications carrier for purposes of 6 providing lifeline service, in addition to any commercial mobile radio 7 or cellular telephone service providers designated as such pursuant to 8 47 U.S.C. § 214(e) and 47 U.S.C. § 214(e)(2), without requiring any such 9 provider to obtain a certificate of public convenience and necessity 10 pursuant to section ninety-nine of this chapter. The commissioner is 11 authorized to promulgate all rules and regulations necessary to imple- 12 ment the provisions of this paragraph. 13 § 2. This act shall take effect immediately.
