        Introduced  by  Sen.  GRIFFO -- read twice and ordered printed, and when
          printed to be committed to the Committee on Local Government
        AN ACT alienating and substituting certain  parklands  in  the  city  of
          Rome, county of Oneida
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subject to the provisions of this act, the city of Rome  in
     2  the  county of Oneida, acting by and through the city council, is hereby
     3  authorized to discontinue as  parklands,  the  lands  more  particularly
     4  described in section three of this act.
     5    § 2. The authorization contained in section one of this act shall take
     6  effect  only  upon the condition that the city of Rome shall dedicate an
     7  amount equal or greater than the fair market value of the property being
     8  alienated in this act toward the  acquisition  of  additional  parklands
     9  and/or capital improvements to existing parklands.
    10    § 3. The parklands authorized by section one of this act to be discon-
    11  tinued as parklands are as follows:
    12    Parcel  1:  That  Piece or Parcel of land situate in the City of Rome,
    13  New York, known as Lot #6 of a tract of land on the Easterly side of the
    14  Rome - Oswego Road known as the Dunham Tract, as shown on a map of  said
    15  tract made by George C.  Schillner, C. E. and filed in the Oneida County
    16  Clerk's  Office  on  October  3,  1919, which said Lot #6 is bounded and
    17  described as follows:
    18    Beginning at a point where the Easterly margin of  Lot  #6  intersects
    19  the center of the so called Oswego Road, being 874.75 feet Westerly from
    20  the  Westerly  rail  of  the  main  track  of the Rome and Watertown and
    21  Ogdensburg Railroad, running thence South 9° 40' East along the Easterly
    22  margin of Lot #6, 524 feet to the Northerly blue line of  the  abandoned
    23  Erie  Canal, thence Westerly along said blue line 225 feet to the South-
    24  easterly corner of Lot #7, Thence North 8° 45' West along  the  Easterly
    25  margin of said Lot #7, 452 feet to the Center of the Oswego Road, thence
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  Easterly  along the Center of the Oswego Road 205.7 feet to the place of
     2  beginning. (2.303 acres)
     3    Parcel  2:  All that certain piece or parcel of land in Rome aforesaid
     4  known as lot no. 7 in the sub-division of lands of  Geo.  E.  Dunham  as
     5  surveyed  by  G.  C.  Schillner  C. E. August 18, 1919., and bounded and
     6  described as follows: Beginning at a point in the center of the  Rome  &
     7  Oswego Road at the intersection of the westerly line of sub-division lot
     8  no.  5  with  the  centre of said Road and running thence west along the
     9  centre of said Road 230 feet; thence south 9° 0" east 394  feet  to  the
    10  blue  line of the abandoned Erie Canal; thence southerly along said blue
    11  line 239 feet; thence north 8° 45' west 452 feet to the centre  of  said
    12  R.  &  O.  Road,  the  place  of beginning, containing according to said
    13  Survey two & 206/1000 acres of land.
    14    § 4. In the event that the city of Rome received any  funding  support
    15  or  assistance from the federal government for the purchase, maintenance
    16  or improvement of the parklands set forth in section three of this  act,
    17  the  discontinuance  and  alienation  of such parkland authorized by the
    18  provisions of section one of this act shall not occur until the city  of
    19  Rome has complied with any federal requirements pertaining to the alien-
    20  ation  or  conversion of such parklands, including satisfying the secre-
    21  tary of the interior that the alienation or conversion complies with all
    22  conditions which the secretary of the interior deems necessary to assure
    23  the substitution of other lands shall be equivalent in fair market value
    24  and usefulness to the lands being alienated or converted.
    25    § 5. This act shall take effect immediately.
