GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- reported favorably from said committee and committed to the Committee on Rules -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT alienating and substituting certain parklands in the city of Rome, county of Oneida The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding the failure of the city of Rome, county of 2 Oneida, to seek and receive state legislative authorization to alienate 3 the parklands described in section four of this act prior to such park- 4 land being alienated, such alienation is hereby validated, legalized, 5 ratified and confirmed. 6 § 2. Subject to the provisions of this act, the city of Rome in the 7 county of Oneida, acting by and through the city council, is hereby 8 authorized to discontinue as waterfront parklands, the lands more 9 particularly described in section four of this act. 10 § 3. The authorization contained in section two of this act shall take 11 effect only upon the condition that the city of Rome shall dedicate an 12 amount equal to or greater than the fair market value of the waterfront 13 parkland being alienated in this act toward the acquisition of addi- 14 tional waterfront parklands and/or toward capital improvements to exist- 15 ing parklands and recreational facilities. 16 § 4. The parklands authorized by section two of this act to be discon- 17 tinued as parklands are as follows: 18 Beginning at a point of the Tract described by Metes and Bounds as 19 follows: 20 THENCE North 86°28'25" East, a distance of 74.63 Feet; 21 THENCE North 79°42'25" East, a distance of 138.07 Feet; 22 THENCE North 79°42'25" East, a distance of 223.58 Feet; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD11556-04-7S. 6338--A 2 1 THENCE South 9°25'5" East, a distance of 508.42 Feet; 2 THENCE North 80°9'30" West, a distance of 47.42 Feet; 3 THENCE North 80°52'30" West, a distance of 142.69 Feet; 4 THENCE North 80°52'30" West, a distance of 274.26 Feet; 5 THENCE North 8°44'59" West, a distance of 362.34 Feet to a point of 6 beginning; 7 Said tract containing 4.34 acres (189118.28 sf) of land, more or less. 8 § 5. In the event that the city of Rome received any funding support 9 or assistance from the federal government for the purchase, maintenance 10 or improvement of the parklands set forth in section four of this act, 11 the discontinuance and alienation of such parkland authorized by the 12 provisions of section two of this act shall not occur until the city of 13 Rome has complied with any federal requirements pertaining to the alien- 14 ation or conversion of such parklands, including satisfying the secre- 15 tary of the interior that the alienation or conversion complies with all 16 conditions which the secretary of the interior deems necessary to assure 17 the substitution of other lands shall be equivalent in fair market value 18 and usefulness to the lands being alienated or converted. 19 § 6. This act shall take effect immediately.
