STATE OF NEW YORK ________________________________________________________________________ 9692 IN SENATE May 21, 2024 ___________ Introduced by Sen. SCARCELLA-SPANTON -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the public authorities law and chapter 47 of the laws of 1931 relating to declaring the policy of the states of New York and New Jersey in regard to certain vehicular bridges and tunnels within the port of New York district, in relation to requiring certain public authorities to establish a cashless tolling amnesty program; and providing for the repeal of certain provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public authorities law is amended by adding a new 2 section 386-c to read as follows: 3 § 386-c. Cashless tolling amnesty program. 1. Notwithstanding any 4 other provisions of this title or any other law, the authority shall 5 provide an amnesty program for any person, firm, corporation, or other 6 entity charged with the payment of a cashless toll fee for the use of 7 any highway, bridge or tunnel operated by the authority between April 8 twenty-third, two thousand sixteen and June twenty-ninth, two thousand 9 twenty-four. 10 2. Such amnesty program shall allow any person, firm, corporation, or 11 other entity charged with the payment of a cashless toll fee for the use 12 of any highway, bridge or tunnel operated by the authority to pay such 13 tolls in full and to have any toll violation fees and penalties related 14 to such paid tolls waived; provided such payment is made on and after 15 August first, two thousand twenty-four and on or before December thir- 16 ty-first, two thousand twenty-four. 17 3. The authority shall conspicuously post on its website information 18 on such amnesty program. 19 § 2. The public authorities law is amended by adding a new section 20 553-l to read as follows: 21 § 553-l. Cashless tolling amnesty program. 1. Notwithstanding any 22 other provisions of this title or any other law, the authority shall 23 provide an amnesty program for any person, firm, corporation, or other 24 entity charged with the payment of a cashless toll fee for the use of EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The public authorities law is amended by adding a new section 14 538-a to read as follows: 15 § 538-a. Cashless tolling amnesty program. 1. Notwithstanding any 16 other provisions of this title or any other law, the authority shall 17 provide an amnesty program for any person, firm, corporation, or other 18 entity charged with the payment of a cashless toll fee for the use of 19 any highway, bridge or tunnel operated by the authority between April 20 twenty-third, two thousand sixteen and June twenty-ninth, two thousand 21 twenty-four. 22 2. Such amnesty program shall allow any person, firm, corporation, or 23 other entity charged with the payment of a cashless toll fee for the use 24 of any highway, bridge or tunnel operated by the authority to pay such 25 tolls in full and to have any toll violation fees and penalties related 26 to such paid tolls waived; provided such payment is made on and after 27 August first, two thousand twenty-four and on or before December thir- 28 ty-first, two thousand twenty-four. 29 3. The authority shall conspicuously post on its website information 30 on such amnesty program. 31 § 4. Chapter 47 of the laws of 1931 relating to declaring the policy 32 of the states of New York and New Jersey in regard to certain vehicular 33 bridges and tunnels within the port of New York district is amended by 34 adding a new section 4B to read as follows: 35 § 4B. Cashless tolling amnesty program. 1. Notwithstanding any other 36 provisions of this act or any other law, the port authority shall 37 provide an amnesty program for any person, firm, corporation, or other 38 entity charged with the payment of a cashless toll fee for the use of 39 any highway, bridge or tunnel operated by such authority between April 40 twenty-third, two thousand sixteen and June twenty-ninth, two thousand 41 twenty-four. 42 2. Such amnesty program shall allow any person, firm, corporation, or 43 other entity charged with the payment of a cashless toll fee for the use 44 of any highway, bridge or tunnel operated by the port authority to pay 45 such tolls in full and to have any toll violation fees and penalties 46 related to such paid tolls waived; provided such payment is made on and 47 after August first, two thousand twenty-four and on or before December 48 thirty-first, two thousand twenty-four. 49 3. The port authority shall conspicuously post on its website informa- 50 tion on such amnesty program. 51 § 5. The public authorities law is amended by adding a new section 52 1279-m to read as follows: 53 § 1279-m. Cashless tolling amnesty program. 1. Notwithstanding any 54 other provisions of this title or any other law, the authority shall 55 provide an amnesty program for any person, firm, corporation, or other 56 entity charged with the payment of a cashless toll fee for the use ofS. 9692 3 1 any highway, bridge or tunnel operated by the authority between April 2 twenty-third, two thousand sixteen and June twenty-ninth, two thousand 3 twenty-four. 4 2. Such amnesty program shall allow any person, firm, corporation, or 5 other entity charged with the payment of a cashless toll fee for the use 6 of any highway, bridge or tunnel operated by the authority to pay such 7 tolls in full and to have any toll violation fees and penalties related 8 to such paid tolls waived; provided such payment is made on and after 9 August first, two thousand twenty-four and on or before December thir- 10 ty-first, two thousand twenty-four. 11 3. The authority shall conspicuously post on its website information 12 on such amnesty program. 13 § 6. This act shall take effect immediately and shall expire and be 14 deemed repealed January 1, 2025; provided, however, section four of this 15 act shall take effect upon the enactment into law by the state of New 16 Jersey of legislation having an identical effect with this act, but if 17 the state of New Jersey shall have already enacted such legislation, 18 this act shall take effect immediately; provided that the state of New 19 Jersey shall notify the legislative bill drafting commission upon the 20 occurrence of the enactment of the legislation provided for in section 21 one of this act in order that the commission may maintain an accurate 22 and timely effective data base of the official text of the laws of the 23 state of New York in furtherance of effectuating the provisions of 24 section 44 of the legislative law and section 70-b of the public offi- 25 cers law. Any rights or remedies granted to an individual pursuant to 26 this act prior to the expiration and repeal of this act shall not be 27 affected by such expiration.
