A BILL
To amend section 3310.02 of the Revised Code to 1
gradually increase to 20,000 the number of 2
Educational Choice Scholarships awarded annually.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3310.02 of the Revised Code be 4
amended to read as follows:5

       Sec. 3310.02. (A) The educational choice scholarship pilot 6
program is hereby established. Under the program, the department 7
of education annually shall pay scholarships to attend chartered 8
nonpublic schools in accordance with section 3310.08 of the 9
Revised Code for up to fourteen thousandthe following number of10
eligible students:11

       (1) Fourteen thousand in each school year through the 12
2011-2012 school year;13

       (2) Fifteen thousand in the 2012-2013 school year;14

       (3) Sixteen thousand in the 2013-2014 school year;15

       (4) Seventeen thousand in the 2014-2015 school year;16

       (5) Eighteen thousand in the 2015-2016 school year;17

       (6) Nineteen thousand in the 2016-2017 school year;18

       (7) Twenty thousand in the 2017-2018 school year and each 19
school year thereafter. If20

       (B) If the number of students who apply for a scholarship 21
exceeds fourteen thousandthe number of scholarships available 22
under division (A) of this section for the applicable school year, 23
the department shall award scholarships in the following order of 24
priority:25

       (A)(1) First, to eligible students who received scholarships 26
in the prior school year;27

       (B)(2) Second, to eligible students with family incomes at or 28
below two hundred per cent of the federal poverty guidelines, as 29
defined in section 5101.46 of the Revised Code, who qualify under 30
division (A) of section 3310.03 of the Revised Code. If the number 31
of students described in this division who apply for a scholarship 32
exceeds the number of available scholarships after awards are made 33
under division (A)(B)(1) of this section, the department shall 34
select students described in this division by lot to receive any 35
remaining scholarships.36

       (C)(3) Third, to other eligible students who qualify under 37
division (A) of section 3310.03 of the Revised Code. If the number 38
of students described in this division who apply for a scholarship 39
exceeds the number of available scholarships after awards are made 40
under divisions (A) and (B)(1) and (2) of this section, the 41
department shall select students described in this division by lot 42
to receive any remaining scholarships.43

       Section 2. That existing section 3310.02 of the Revised Code 44
is hereby repealed.45
