A BILL
To enact section 2927.121 of the Revised Code to 1
create the offense of intimidation of a homeless 2
person.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 2927.121 of the Revised Code be 4
enacted to read as follows:5

       Sec. 2927.121. (A) As used in this section, "homeless person" 6
means either of the following:7

       (1) An individual who lacks a fixed, regular, and adequate 8
nighttime residence;9

       (2) An individual who has a primary nighttime residence that 10
meets any of the following criteria:11

       (a) A supervised publicly or privately operated shelter 12
designed to provide temporary living accommodations;13

       (b) An institution that provides a temporary residence for 14
individuals intended to be institutionalized;15

       (c) A public or private place not designed for, or ordinarily 16
used as, a regular sleeping accommodation for human beings.17

       (B) No person shall violate section 2903.04, 2903.041, 18
2903.05, 2903.11, 2903.12, 2903.13, 2903.14, 2903.21, 2903.211, 19
2903.22, 2903.31, 2905.01, 2905.02, 2905.03, 2905.11, 2905.12, 20
2907.01, 2907.03, 2907.05, 2907.06, 2909.01, 2909.02, 2909.03, 21
2909.05, 2909.06, 2909.07, 2911.02, 2913.01, 2913.02, or 2917.01 22
of the Revised Code if the offender commits the violation with the 23
intent to cause harm to any victim of the violation because that 24
victim is a homeless person.25

       (C) Whoever violates this section is guilty of intimidation 26
of a homeless person. Intimidation of a homeless person is an 27
offense of the next higher degree than the offense the commission 28
of which is a necessary element of intimidation of a homeless 29
person.30
