BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 4955.50 of the Revised Code be | 5 |
enacted to read as follows: | 6 |
Sec. 4955.50. (A) Every railroad company that maintains | 7 |
railroad tracks within this state shall install and maintain | 8 |
reflective banners on all hand-thrown switches and derails that | 9 |
connect with main track line. Each banner shall be clearly visible | 10 |
from the operator's position on an approaching locomotive so as to | 11 |
serve as a warning to the operator of the presence of a | 12 |
hand-thrown switch or derail. | 13 |
(B) No railroad company that maintains railroad tracks within | 14 |
this state shall fail to comply with division (A) of this section. | 15 |
(C) A railroad company that violates division (B) of this | 16 |
section is guilty of a minor misdemeanor for every reflective | 17 |
banner that is not properly installed or maintained on a | 18 |
hand-thrown switch or derail as required by division (A) of this | 19 |
section. | 20 |
