A BILL
To amend section 924.52 of the Revised Code to revise 1
the duties of the Ohio Grape Industries Committee.2


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 924.52 of the Revised Code be 3
amended to read as follows:4

       Sec. 924.52.  (A) The Ohio grape industries committee may:5

       (1) Conduct, and contract with others to conduct, research, 6
including the study, analysis, dissemination, and accumulation of 7
information obtained from the research or elsewhere, concerning 8
the marketing and distribution of grapes and grape products, the 9
storage, refrigeration, processing, and transportation of them, 10
and the production and product development of grapes and grape 11
products. The committee shall expend for these activities no less 12
than thirty per cent and no more than seventy per cent of all 13
money it receives from the Ohio grape industries fund created 14
under section 924.54 of the Revised Code.;15

       (2) Provide the wholesale and retail trade with information 16
relative to proper methods of handling and selling grapes and 17
grape products;18

       (3) Make or contract for market surveys and analyses, 19
undertake any other similar activities that it determines are 20
appropriate for the maintenance and expansion of present markets 21
and the creation of new and larger markets for grapes and grape 22
products, and make, in the name of the committee, contracts to 23
render service in formulating and conducting plans and programs 24
and such other contracts or agreements as the committee considers 25
necessary for the promotion of the sale of grapes and grape 26
products. The committee shall expend for these activities no less 27
than thirty per cent and no more than seventy per cent of all 28
money it receives from the fund.;29

       (4) Publish and distribute to producers and others 30
information relating to the grape and grape product industries;31

       (5) Propose to the director of agriculture for adoption, 32
rescission, or amendment, pursuant to Chapter 119. of the Revised 33
Code, rules necessary for the exercise of its powers and the 34
performance of its duties;35

       (6) Advertise for, post notices seeking, or otherwise solicit 36
applicants to serve in administrative positions in the department 37
of agriculture as employees who support the administrative 38
functions of the committee. Applications shall be submitted to the 39
committee. The committee shall select applicants that it wishes to 40
recommend for employment and shall submit a list of the 41
recommended applicants to the director.42

       (7) For the public purpose of promoting the grape industry, 43
provide to wine producers and persons that grow grapes in this 44
state grape plants, grape vines, equipment, and material to assist 45
in the production of grapes and grape products.46

       (B) The committee shall:47

       (1) Promote the sale of grapes and grape products for the 48
purpose of maintaining and expanding present markets and creating 49
new and larger intrastate, interstate, and foreign markets for 50
grapes and grape products, and inform the public of the uses and 51
benefits of grapes and grape products;52

       (2) Perform all acts and exercise all powers incidental to, 53
in connection with, or considered reasonably necessary, proper, or 54
advisable to effectuate the purposes of this section.55

       Section 2.  That existing section 924.52 of the Revised Code 56
is hereby repealed.57
