A CONCURRENT RESOLUTION
To urge the Congress of the United States and the 1
President of the United States to repeal the new 2
federal excise tax on medical devices.3


BE IT RESOLVED BY THE SENATE OF THE STATE OF OHIO
(THE HOUSE OF REPRESENTATIVES CONCURRING):


       WHEREAS, A new 2.3% federal excise tax on the sale of taxable 4
medical devices by manufacturers, producers, and importers of such 5
devices took effect on January 1, 2013; and6

        WHEREAS, The Joint Committee on Taxation estimates that the 7
tax will generate $29 billion in revenue in its first ten years; 8
and9

        WHEREAS, The United States is a net exporter in medical 10
devices, exporting $5.4 billion more than it imports, and accounts 11
for 40% of the global medical technology market; and12

        WHEREAS, A study completed by the Manhattan Institute found 13
that the medical device tax will almost double the medical device 14
industry's total tax bill and could result in the loss of up to 15
43,000 jobs in the medical technology industry; and16

        WHEREAS, The medical device tax will harm the United States' 17
global competitiveness, stunt medical innovation, and restrict the 18
ability of patients to receive the life-saving medical devices and 19
care they need; and20

       WHEREAS, The medical device tax is imposed on United States 21
sales, rather than profits, of medical device manufacturers, so 22
will be particularly damaging to innovative start-up companies; 23
now therefore be it24

        RESOLVED, That we, the members of the 130th General Assembly 25
of the State of Ohio, on behalf of all citizens of this state, 26
urge the President of the United States and the Congress of the 27
United States to repeal the excise tax on medical devices; and be 28
it further29

        RESOLVED, That the Clerk of the Senate transmit duly 30
authenticated copies of this resolution to the President of the 31
United States, the President Pro Tempore and Secretary of the 32
United States Senate, the Speaker and Clerk of the United States 33
House of Representatives, each member of the Ohio Congressional 34
delegation, and the news media of Ohio.35
