| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, further providing for use of force in |
3 | self-protection. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 505(b)(2.3) of Title 18 of the |
7 | Pennsylvania Consolidated Statutes, added June 28, 2011 (P.L.48, |
8 | No.10), is amended to read: |
9 | § 505. Use of force in self-protection. |

11 | (b) Limitations on justifying necessity for use of force.-- |
12 | * * * |
13 | (2.3) An actor who is not engaged in a criminal |
14 | activity, and who is attacked in any place where the actor |
15 | would have a duty to retreat under paragraph (2)(ii), has no |

1 | duty to retreat and has the right to stand his ground and use |
2 | force, including deadly force, if all of the following |
3 | subparagraphs apply: |
4 | (i) [the] The actor has a right to be in the place |
5 | where he was attacked[;]. |
6 | (ii) [the] The actor believes it is immediately |
7 | necessary to do so to protect himself against death, |
8 | serious bodily injury, kidnapping or sexual intercourse |
9 | by force or threat[; and]. |
10 | (iii) [the] Any of the following clauses apply: |
11 | (A) The person against whom the force is used |
12 | displays or otherwise uses[: |
13 | (A)] a firearm or replica of a firearm as |
14 | defined in 42 Pa.C.S. § 9712 (relating to sentences |
15 | for offenses committed with firearms)[; or]. |
16 | (B) The person against whom the force is used |
17 | displays or otherwise uses any other weapon readily |
18 | or apparently capable of lethal use. |
19 | (C) The person against whom the force is used |
20 | displays or possesses the physical power, stature or |
21 | ability to kill or inflict serious bodily injury and |
22 | the actor believes it is necessary to protect himself |
23 | against death, serious bodily injury, kidnapping or |
24 | sexual intercourse by force or threat. |
25 | (D) The persons against whom the force is used |
26 | outnumber the actor such that he reasonably fears |
27 | death, serious bodily injury, kidnapping or sexual |
28 | intercourse by force or threat. |

30 | Section 2. This act shall take effect in 60 days. |
