| AN ACT |
| |
1 | Amending the act of August 9, 1955 (P.L.323, No.130), entitled, |
2 | as amended, "An act relating to counties of the first, third, |
3 | fourth, fifth, sixth, seventh and eighth classes; amending, |
4 | revising, consolidating and changing the laws relating |
5 | thereto; relating to imposition of excise taxes by counties, |
6 | including authorizing imposition of an excise tax on the |
7 | rental of motor vehicles by counties of the first class; and |
8 | providing for regional renaissance initiatives," further |
9 | providing for requests for examinations and reports and for |
10 | official records of coroner. |
11 | The General Assembly of the Commonwealth of Pennsylvania |
12 | hereby enacts as follows: |
13 | Section 1. Section 1236.1 of the act of August 9, 1955 |
14 | (P.L.323, No.130), known as The County Code, added November 29, |
15 | 1990 (P.L.602, No.152), is amended to read: |
16 | Section 1236.1. Requests for Examinations and Reports.--(a) |
17 | Requests for examinations or other professional services by |
18 | other counties or persons may be complied with at the discretion |
19 | of the coroner pursuant to guidelines established by the county |

1 | commissioners. |
2 | (b) A set of fees and charges for such examinations or |
3 | professional services shall be established by the coroner, |
4 | subject to approval by the county commissioners, and shall be |
5 | accounted for and paid to the county treasurer pursuant to |
6 | section 1760. Payment for examinations or professional services |
7 | shall be the responsibility of the county or person requesting |
8 | such services. |
9 | (c) The coroner may charge and collect a fee of up to [one |
10 | hundred dollars ($100)] five hundred dollars ($500) for each |
11 | autopsy report, up to [fifty dollars ($50)] one hundred dollars |
12 | ($100) for each toxicology report, up to [fifty dollars ($50)] |
13 | one hundred dollars ($100) for each inquisition or coroner's |
14 | report and such other fees as may be established from time to |
15 | time for other reports and documents requested by |
16 | nongovernmental agencies. The fees collected shall be accounted |
17 | for and paid to the county treasurer pursuant to section 1760 |
18 | and shall be used to defray the expenses involved in the county |
19 | complying with the provisions of the act of March 2, 1988 |
20 | (P.L.108, No.22), referred to as the Coroners' Education Board |
21 | Law. |
22 | Section 2. Section 1251 of the act is amended to read: |
23 | Section 1251. [Official] Records of Coroner.--(a) Every |
24 | coroner, within thirty (30) days after the end of each year, |
25 | shall [deposit all of his official records and papers for] file |
26 | the following information for each death investigated by the |
27 | coroner during the preceding year in the office of the |
28 | prothonotary for [the] public inspection [of all persons |
29 | interested therein.]: |
30 | (1) Name of decedent. |

1 | (2) Address. |
2 | (3) Date of death. |
3 | (4) Cause and manner of death. |
4 | (5) Age. |
5 | (6) Sex. |
6 | (b) Examinations and reports under section 1236.1 and |
7 | sensitive or privileged information about a decedent's medical |
8 | history shall not be open to public inspection. |
9 | Section 3. This act shall take effect in 60 days. |
