AN ACT

 

1Amending Title 23 (Domestic Relations) of the Pennsylvania
2Consolidated Statutes, further providing for willful failure
3to pay support order.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Section 4354(d) of Title 23 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 4354.  Willful failure to pay support order.

10(d)  Grading.--

11(1)  Except as otherwise provided for in paragraph (2),
12an offense under this section shall constitute a summary
13offense.

14(2)  [An offense shall be graded a misdemeanor of the 
15third degree if the individual convicted of the offense 
16established residence outside this Commonwealth with the 

1intention of not complying with the support order and] An 
2offense shall be graded as a misdemeanor to which the 
3individual shall, upon conviction, be sentenced to a term of 
4imprisonment not to exceed six months and to pay a fine of up 
5to $2,500 if either of the following apply:

6(i)  the offense is a second or subsequent offense
7under this section; or

8(ii)  the individual owes support in an amount equal
9to or greater than 12 months of the monthly support
10obligation.

12Section 2.  The amendment of 23 Pa.C.S. § 4354(d) shall apply
13to offenses committed on or after the effective date of this
14section.

15Section 3.  This act shall take effect in 60 days.
