AN ACT

 

1Amending Title 42 (Judiciary and Judicial Procedure) of the
2Pennsylvania Consolidated Statutes, further providing for
3sexual offender registration procedures.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 9795.2(a)(4)(i) and (b)(4)(i) of Title 42
7of the Pennsylvania Consolidated Statutes, are amended to read:

8§ 9795.2. Registration procedures and applicability.

9(a) Registration.--

11(4) This paragraph shall apply to all offenders and
12sexually violent predators:

13(i) Where the offender or sexually violent predator
14was granted parole by the Pennsylvania Board of Probation
15and Parole or the court or is sentenced to probation or

1intermediate punishment, the board or county office of
2probation and parole shall collect registration
3information from the offender or sexually violent
4predator and forward that registration information to the
5Pennsylvania State Police. The Department of Corrections
6or county correctional facility shall not release the
7offender or sexually violent predator until it receives
8verification from the Pennsylvania State Police that it
9has received the registration information and has posted 
10the registration information on the Internet as required 
11under section 9798.1 (relating to information made 
12available on the Internet and electronic notification).
13Verification by the Pennsylvania State Police may occur
14by electronic means, including e-mail or facsimile
15transmission. Where the offender or sexually violent
16predator is scheduled to be released from a State
17correctional facility or county correctional facility
18because of the expiration of the maximum term of
19incarceration, the Department of Corrections or county
20correctional facility shall collect the information from
21the offender or sexually violent predator no later than
22ten days prior to the maximum expiration date. The
23registration information shall be forwarded to the
24Pennsylvania State Police and shall be posted on the 
25Internet as required under section 9798.1 prior to the 
26maximum expiration date.

28(b) Individuals convicted or sentenced by a court or
29adjudicated delinquent in jurisdictions outside this
30Commonwealth or sentenced by court martial.--

1(4) An individual who has a residence, is employed or is 
2a student in this Commonwealth and who has been convicted of 
3or sentenced by a court or court martialed for a sexually 
4violent offense or a similar offense under the laws of the 
5United States or one of its territories or possessions, 
6another state, the District of Columbia, the Commonwealth of 
7Puerto Rico or a foreign nation, or who was required to 
8register under a sexual offender statute in the jurisdiction 
9where convicted, sentenced or court martialed, shall register 
10at an approved registration site within 48 hours of the 
11individual's arrival in this Commonwealth. The provisions of 
12this subchapter shall apply to the individual as follows:

13(i) If the individual has been classified as a
14sexually violent predator as defined in section 9792
15(relating to definitions) or determined under the laws of
16the other jurisdiction or by reason of court martial to
17be subject to active notification and lifetime
18registration on the basis of a statutorily authorized
19administrative or judicial decision or on the basis of a
20statute or administrative rule requiring active
21notification and lifetime registration based solely on
22the offense for which the individual was convicted,
23sentenced or court martialed, the individual shall,
24notwithstanding section 9792, be considered a sexually
25violent predator and subject to lifetime registration
26pursuant to section 9795.1(b) [(relating to
27registration)]. The individual shall also be subject to
28the provisions of this section and sections 9796
29(relating to verification of residence), 9798 (relating
30to other notification) and 9798.1(c)(1) [(relating to

1information made available on the Internet and electronic 
2notification)], except that the individual shall not be
3required to receive counseling unless required to do so
4by the other jurisdiction or by reason of court martial.

6Section 2. This act shall take effect in 60 days.
