AN ACT

Amending Title 23 (Domestic Relations) of the Pennsylvania

2

Consolidated Statutes, in child protective services, further

3

providing for release of information in confidential reports.

4

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 6340 of Title 23 of the Pennsylvania

7

Consolidated Statutes is amended by adding a subsection to read:

8

§ 6340.  Release of information in confidential reports.

(e)  Notification of mandated reporter.--

11

(1)  The department shall provide a mandated reporter

12

under subsection (a)(12) with the information that can be

13

released pursuant to subsection (a)(12) within 30 days

14

following a determination of whether the child abuse report

15

is indicated, founded or unfounded.

16

(2)  Within 60 days following receipt of the information,

17

the mandated reporter may submit a request to the department,

on a form provided to the mandated reporter at the time of

2

notice of information under paragraph (1), for the department

3

to review the report of suspected child abuse made by the

4

mandated reporter and the investigation of the report of

5

suspected child abuse conducted either by a county agency or

6

the department for any of the following reasons:

7

(i)  The report is determined to be unfounded.

8

(ii)  No services are provided, arranged for or to be

9

provided by the county agency to protect the child.

10

(3)  The department shall acknowledge receipt of the

11

request for review, complete its review within 60 days and

12

notify the mandated reporter of its findings within 30 days

13

following completion of its review.

14

Section 2.  This act shall take effect in 60 days.
