AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, further providing for arson and

3

related offenses.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 3301 of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended by adding a subsection to read:

8

§ 3301.  Arson and related offenses.

(h.2)  Background checks for prospective firefighters.--An

11

applicant for certification under 35 Pa.C.S. § 7384 (relating to

12

Pennsylvania State Fire Academy) for employment as a

13

firefighter, or an individual seeking to join a volunteer fire

14

company as a firefighter, shall be required to submit to a

15

criminal history background investigation which shall include

16

records of criminal arrests and convictions, no matter where

17

occurring, including Federal criminal history record

18

information, prior to being enrolled in a firefighter training

program or offered employment as a firefighter or membership in

2

a volunteer fire company. The applicant shall submit to

3

fingerprinting by the Pennsylvania State Police or by a local

4

law enforcement agency capable of submitting fingerprints

5

electronically to the Pennsylvania State Police utilizing the

6

Integrated Automated Fingerprint Identification System or in a

7

manner and in such form as may be provided by the Pennsylvania

8

State Police. Fingerprinting under this part shall require, at a

9

minimum, submission of a full set of fingerprints. The

10

Pennsylvania State Police shall submit the fingerprints to the

11

Federal Bureau of Investigation for purposes of verifying the

12

identity of the applicant and obtaining records of criminal

13

arrests and convictions and shall provide the same to the

14

municipality or volunteer fire company. Fingerprints obtained

15

under this subsection may be maintained by the Pennsylvania

16

State Police for general law enforcement purposes. The costs of

17

fingerprinting and completion of the criminal background

18

investigation shall be paid by the applicant, except that

19

nothing in this section shall be construed to prohibit the

20

municipality in which the individual is seeking employment or in

21

which the volunteer fire company is located from paying for the

22

cost of the fingerprinting and criminal background investigation

23

or from reimbursing the individual for such costs. A criminal

24

history background investigation completed under this subsection

25

shall be valid for 45 days.

Section 2.  This act shall take effect in 60 days.
