AN ACT

Amending the act of July 8, 2007 (P.L.90, No.28), entitled "An

2

act permitting a mother the freedom to nurse her child in

3

public; and providing that breastfeeding may not be

4

considered a nuisance, indecent exposure, sexual conduct or

5

obscenity," further providing for declaration of policy; and 

6

providing for information.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Section 2 of the act of July 8, 2007 (P.L.90,

10

No.28), known as the Freedom to Breastfeed Act, is amended to

11

read:

Section 2.  Declaration of policy.

13

The General Assembly finds that breastfeeding a baby is an

14

important and basic act of nurturing that must be protected in

15

the interests of maternal and child health and family values,

16

and increased attention must be paid to the needs of

17

breastfeeding children and mothers who breastfeed or express

18

breast milk.

Section 2.  The act is amended by adding a section to read:

Section 5.  Information.

The Department of Labor and Industry and Department of Health

2

shall make available to the general public on the departments'

3

Internet websites information and links to other websites where

4

the public can access information concerning breastfeeding and

5

expressing breast milk, including information relating to

6

expressing breast milk in the workplace. The Department of Labor

7

and Industry shall make available on its Internet website

8

information to assist and encourage employers, employment

9

agencies and labor organizations to provide a room or other

10

location in close proximity to the work area, other than a

11

toilet stall, where an employee can express breast milk in

12

privacy. With the assistance of health care providers the

13

Department of Health shall develop written materials concerning

14

this act for distribution to women of childbearing age.

Section 3.  This act shall take effect in 60 days.
