AN ACT

 

1Amending Title 65 (Public Officers) of the Pennsylvania
2Consolidated Statutes, further providing for prohibited
3activities.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Section 13A07(e)(1) and (2) of Title 65 of the
7Pennsylvania Consolidated Statutes are amended by adding
8subparagraphs and the section is amended by adding a subsection
9to read:

10§ 13A07.  Prohibited activities.

12(e)  Contingent compensation.--

13(1)  A person may not compensate or incur an obligation
14to compensate a person to engage in lobbying for compensation
15contingent in whole or in part upon any of the following:

17(iii)  The receipt or award of a grant, credit, loan,

1capital funding, contract or any other form of
2Commonwealth funds awarded by an agency. The provisions
3of this subparagraph shall apply to an affiliated entity.

4(2)  A person may not engage in or agree to engage in
5lobbying for compensation contingent in whole or in part upon
6any:

8(iii)  The receipt or award of any grant, credit,
9loan, capital funding, contract or any other form of
10Commonwealth funds awarded by an agency. The provisions
11of this subparagraph shall apply to an affiliated entity.

13(g)  Definitions.--The following words and phrases when used
14in this section shall have the meanings given to them in this
15subsection unless the context clearly indicates otherwise:

16"Affiliated entity."  Any of the following:

17(1)  A subsidiary or holding company of a lobbying firm
18or other business entity owned in whole or in part by a
19lobbying firm.

20(2)  An organization recognized by the IRS as a tax-
21exempt organization under section 501(c) of the Internal
22Revenue Code of 1986 (Public Law 99-514, 26 U.S.C. § 501(c))
23established by a lobbyist or lobbying firm or an affiliated
24entity.

25Section 2.  This act shall take effect in 60 days.
