AN ACT

Amending Title 66 (Public Utilities) of the Pennsylvania

2

Consolidated Statutes, further providing for termination of

3

utility service.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 1406(b) of Title 66 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 1406.  Termination of utility service.

9

(b)  Notice of termination of service.--

11

(1)  Prior to terminating service under subsection (a), a

12

public utility:

13

(i)  Shall provide written notice of the termination

14

to the customer at least ten days prior to the date of

15

the proposed termination. The termination notice shall

16

remain effective for 60 days.

17

(ii)  Shall [attempt to] contact the customer or

18

occupant[, either in person or] by telephone, to provide

notice of the proposed termination at least three days

2

prior to the scheduled termination. [Phone contact shall

3

be deemed complete upon attempted calls on two separate

4

days to the residence between the hours of 7 a.m. and 9

5

p.m. if the calls were made at various times each day.]

6

(iii)  [During the months of December through March,

7

unless] In addition to the contact made under

8

subparagraph (ii), the utility shall attempt personal

9

contact [has been made] with the customer or responsible

10

adult by personally visiting the customer's residence[,

11

the public utility shall,] within 48 hours of the

12

scheduled date of termination[,] and if contact cannot be

13

made shall post a notice of the proposed termination at

14

the service location. This subparagraph shall apply to a

15

city natural gas distribution operation only during the

16

months of December through March.

17

(iv)  After complying with paragraphs (ii) and (iii),

18

the public utility shall attempt to make personal contact

19

with the customer or responsible adult at the time

20

service is terminated. Termination of service shall not

21

be delayed for failure to make personal contact.

22

(2)  The public utility shall not be required by the

23

commission to take any additional actions prior to

24

termination.

Section 2.  This act shall take effect in 60 days.
