AN ACT

Amending the act of April 9, 1929 (P.L.343, No.176), entitled,

2

as amended, "An act relating to the finances of the State

3

government; providing for the settlement, assessment,

4

collection, and lien of taxes, bonus, and all other accounts

5

due the Commonwealth, the collection and recovery of fees and

6

other money or property due or belonging to the Commonwealth,

7

or any agency thereof, including escheated property and the

8

proceeds of its sale, the custody and disbursement or other

9

disposition of funds and securities belonging to or in the

10

possession of the Commonwealth, and the settlement of claims

11

against the Commonwealth, the resettlement of accounts and

12

appeals to the courts, refunds of moneys erroneously paid to

13

the Commonwealth, auditing the accounts of the Commonwealth

14

and all agencies thereof, of all public officers collecting

15

moneys payable to the Commonwealth, or any agency thereof,

16

and all receipts of appropriations from the Commonwealth,

17

authorizing the Commonwealth to issue tax anticipation notes

18

to defray current expenses, implementing the provisions of

19

section 7(a) of Article VIII of the Constitution of

20

Pennsylvania authorizing and restricting the incurring of

21

certain debt and imposing penalties; affecting every

22

department, board, commission, and officer of the State

23

government, every political subdivision of the State, and

24

certain officers of such subdivisions, every person,

25

association, and corporation required to pay, assess, or

26

collect taxes, or to make returns or reports under the laws

27

imposing taxes for State purposes, or to pay license fees or

28

other moneys to the Commonwealth, or any agency thereof,

29

every State depository and every debtor or creditor of the

30

Commonwealth," providing for the Commonwealth Technology

31

Fund.

hereby enacts as follows:

Section 1.  Article XVII-A of the act of April 9, 1929

3

(P.L.343, No.176), known as The Fiscal Code, is amended by

4

adding a subarticle to read:

5

Section 2.  The act is amended by adding an article to read:

SUBARTICLE A

14

COMMONWEALTH TECHNOLOGY FUND

15

Section 1701-O.  Establishment of Commonwealth Technology Fund.

16

There is hereby established a fund within the State Treasury

17

to be called the Commonwealth Technology Fund.

18

Section 1702-O.  Transfer to Commonwealth Technology Fund.

19

The Secretary of the Budget shall transfer the sum of

20

$25,000,000 of proceeds from the tax imposed under Article II of

21

the act of March 4, 1971 (P.L.6, No.2), known as the Tax Reform

22

Code of 1971, to the Commonwealth Technology Fund by September

23

30 of each year.

Section 1703-O.  Use of Commonwealth Technology Fund.

25

(a)  Request by Governor.--As a component to the annual

26

budget submission required under section 613 of the act of April

27

9, 1929 (P.L.177, No.175), known as The Administrative Code of

28

1929, the Governor shall provide a request for utilizing the

29

moneys that the Governor reasonably expects to be in the

30

Commonwealth Technology Fund within the fiscal year covered by

the budget. The request shall list the departments, agencies,

2

offices or commissions and the dollar amount that each would

3

receive in the upcoming fiscal year, a brief description of the

4

project and an estimate of the total cost of each project if it

5

is a multiyear project.

(b)  Description of project.--As part of the budget

7

information submitted under section 619(d) of the Administrative

8

Code of 1929 any department, agency, office or commission

9

expected to receive funds under subsection (a) shall include a

10

detailed description of the technology project that would be

11

funded. This description shall include a detailed explanation of

12

the hardware and software that will be purchased, the

13

anticipated date of these purchases, the expected vendors and

14

the reason that the project is necessary and the amount of any

15

expected savings from the project.

(c)  Requirement for funds.--For a project to be eligible for

17

funding under this subarticle the project must be for computing

18

technology, such as networking, hardware, software, the Internet

19

or telecommunications to process and distribute information in

20

digital form.

21

(d)  List of projects.--The General Assembly may, in

22

consultation with the Governor, amend the list of projects that

23

will be funded. No funds shall be spent unless appropriated.

24

Section 3.  This act shall take effect in 60 days.
