AN ACT
Providing for quarterly interim payments to certain providers of
community mental retardation services; and providing for
powers and duties of the Department of Public Welfare.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Community
Mental Retardation System Financial Stability Act.
Section 2. Quarterly interim payments required.
The Department of Public Welfare shall make interim payments
to providers of community mental retardation services that are
enrolled in the Medicaid program on the first day of each
calendar quarter: July 1, October 1, January 1 and April 1 of
each year. The quarterly interim payments shall be subject to
ongoing reconciliation resulting from periodic billings for
services submitted by enrolled providers and to annual
reconciliations of such billings.
Section 3. Calculation.
The quarterly interim payments shall be the average of the
adjudicated billings for each provider for the two quarters
prior to each such payment.
Section 4. Inconsistent repeal.
Section 509 of the act of October 20, 1966 (3rd Sp.Sess.,
P.L.96, No.6), known as the Mental Health and Mental Retardation
Act of 1966, is hereby repealed to the extent of any
inconsistency with the provisions of this act. Section 509 of
the Mental Health and Mental Retardation Act of 1966 shall
continue to apply to community mental health services.
Section 5. Effective date.
This act shall take effect in 60 days.
