| AN ACT |
| |
1 | Providing for quarterly interim payments to certain providers of |
2 | community mental retardation services; and providing for |
3 | powers and duties of the Department of Public Welfare. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Short title. |
7 | This act shall be known and may be cited as the Community |
8 | Mental Retardation System Financial Stability Act. |
9 | Section 2. Quarterly interim payments required. |
10 | The Department of Public Welfare shall make interim payments |
11 | to providers of community mental retardation services that are |
12 | enrolled in the Medicaid program on the first day of each |
13 | calendar quarter: July 1, October 1, January 1 and April 1 of |
14 | each year. The quarterly interim payments shall be subject to |
15 | ongoing reconciliation resulting from periodic billings for |
16 | services submitted by enrolled providers and to annual |
17 | reconciliations of such billings. |

1 | Section 3. Calculation. |
2 | The quarterly interim payments shall be the average of the |
3 | adjudicated billings for each provider for the two quarters |
4 | prior to each such payment. |
5 | Section 4. Inconsistent repeal. |
6 | Section 509 of the act of October 20, 1966 (3rd Sp.Sess., |
7 | P.L.96, No.6), known as the Mental Health and Mental Retardation |
8 | Act of 1966, is hereby repealed to the extent of any |
9 | inconsistency with the provisions of this act. Section 509 of |
10 | the Mental Health and Mental Retardation Act of 1966 shall |
11 | continue to apply to community mental health services. |
12 | Section 5. Effective date. |
13 | This act shall take effect in 60 days. |
