relating to authorizing the payment to employees of the Texas | ||
Department of Criminal Justice for vacation leave. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 493, Government Code, is amended by | ||
adding Section 493.035 to read as follows: | ||
Sec. 493.035. PAYMENT FOR VACATION LEAVE. (a) An employee | ||
of the department may, one time during a fiscal year, elect to | ||
receive a lump-sum payment for the employee's accumulated vacation | ||
leave in lieu of taking the leave. | ||
(b) The number of hours of accumulated vacation leave for | ||
which an employee may be paid under this section may not exceed all | ||
of the employee's accumulated vacation leave or 40 hours of | ||
accumulated vacation leave, whichever is less. | ||
(c) On receiving payment under this section, the number of | ||
hours for which the employee received payment are deducted from the | ||
employee's accumulated vacation leave balance. | ||
(d) Payment to an employee under this section shall be | ||
computed by multiplying the employee's hourly rate of compensation | ||
on the date the employee notifies the department of an election | ||
under this section by the number of hours of accumulated vacation | ||
leave for which the employee elects to be paid. | ||
SECTION 2. This Act takes effect September 1, 2023. |
