A BILL TO BE ENTITLED
 
AN ACT
  relating to authorizing the payment to employees of the Texas
  Department of Criminal Justice for vacation leave.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 493, Government Code, is amended by
  adding Section 493.035 to read as follows:
         Sec. 493.035.  PAYMENT FOR VACATION LEAVE. (a) The
  department may adopt a policy allowing department employees, one
  time during a fiscal year, to elect to receive a lump-sum payment
  for the employee's accumulated vacation leave in lieu of taking the
  leave.
         (b)  The number of hours of accumulated vacation leave for
  which an employee may be paid under a policy authorized by this
  section may not exceed all of the employee's accumulated vacation
  leave or 40 hours of accumulated vacation leave, whichever is less.
         (c)  If the department pays a department employee for the
  employee's accumulated vacation leave under a policy authorized by
  this section, the department shall:
               (1)  compute the amount of the payment by multiplying
  the employee's hourly rate of compensation on the date the employee
  notifies the department of an election by the number of hours of
  accumulated vacation leave for which the employee elects to be
  paid; and
               (2)  on making the payment, deduct the number of hours
  for which the employee received payment from the employee's
  accumulated vacation leave balance.
         SECTION 2.  This Act takes effect September 1, 2023.
