| relating to exempting certain low-income students from the payment | ||
| of certain fees at a public institution of higher education. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 54, Education Code, is | ||
| amended by adding Section 54.369 to read as follows: | ||
| Sec. 54.369. FEE EXEMPTION FOR CERTAIN LOW-INCOME STUDENTS. | ||
| (a) Notwithstanding any other law, an institution of higher | ||
| education shall exempt from the payment of fees authorized under | ||
| Subchapter E any student who: | ||
| (1) is eligible for student financial assistance | ||
| provided by this state; and | ||
| (2) has a family income that is below the federal | ||
| poverty line. | ||
| (b) The Texas Higher Education Coordinating Board shall | ||
| adopt rules for the administration of this section. | ||
| SECTION 2. Section 54.369, Education Code, as added by this | ||
| Act, applies beginning with fees charged by a public institution of | ||
| higher education for the 2014-2015 academic year. | ||
| SECTION 3. The Texas Higher Education Coordinating Board | ||
| shall adopt any rules necessary under Section 54.369, Education | ||
| Code, as added by this Act, as soon as practicable after this Act | ||
| takes effect. For that purpose, the coordinating board may adopt | ||
| the initial rules in the manner provided by law for emergency rules. | ||
| SECTION 4. This Act takes effect September 1, 2013. | ||
