relating to a restriction on the types of oil and gas wastes that | ||
may be disposed of in a surface pit without a permit issued by the | ||
Railroad Commission of Texas. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter D, Chapter 91, Natural Resources | ||
Code, is amended by adding Section 91.1014 to read as follows: | ||
Sec. 91.1014. DISPOSAL OF CERTAIN OIL AND GAS WASTES. The | ||
commission may not authorize by rule the surface disposal of oil and | ||
gas waste without a permit if the oil and gas waste has: | ||
(1) a chloride concentration of more than 3,000 | ||
milligrams per liter; | ||
(2) a total petroleum hydrocarbon concentration of | ||
more than 10,000 milligrams per kilogram; or | ||
(3) a concentration of benzene, toluene, | ||
ethylbenzene, and xylene of more than 30 milligrams per kilogram. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2017. |
