relating to notice provided to certain local officials regarding | ||
the use of land application to treat and dispose of certain oil and | ||
gas waste. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter D, Chapter 91, Natural Resources | ||
Code, is amended by adding Section 91.118 to read as follows: | ||
Sec. 91.118. NOTIFICATION OF LAND APPLICATION OF CERTAIN | ||
WASTE. If the commission adopts rules requiring a permit to use | ||
land application to treat and dispose of oil field fluids or oil and | ||
gas wastes, the commission by rule shall require a person who files | ||
an application for a permit to provide written notice to: | ||
(1) each groundwater conservation district in the area | ||
in which the land application will occur; | ||
(2) the mayor of each municipality in the area in which | ||
the land application will occur; and | ||
(3) the county judge of each county in the area in | ||
which the land application will occur. | ||
SECTION 2. Section 91.118, Natural Resources Code, as added | ||
by this Act, applies only to an application for a permit to use land | ||
application to treat and dispose of oil field fluids or oil and gas | ||
wastes that is filed with the Railroad Commission of Texas on or | ||
after the effective date of this Act. An application for a permit | ||
that was filed with the commission before the effective date of this | ||
Act is governed by the law as it existed on the date the application | ||
was filed, and that law is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2011. |
