relating to the authority of certain counties to acquire a | ||
right-of-way in accordance with the county's master drainage plan. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 561, Local Government Code, is amended | ||
by adding Section 561.0075 to read as follows: | ||
Sec. 561.0075. AUTHORITY TO ACQUIRE RIGHT-OF-WAY REQUIRED | ||
BY MASTER DRAINAGE PLAN IN CERTAIN COUNTIES. (a) This section | ||
applies only to a county with a population of 3.3 million or more. | ||
(b) After notice of a master drainage plan is published in a | ||
newspaper of general circulation in the county | ||
, or on a county | ||
website, the commissioners court of a county may acquire a | ||
right-of-way on a strip of land that is undeveloped or part of a new | ||
site development or redevelopment plan if the acquisition is | ||
required by the county's master drainage plan. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2019. |
