state. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article I, Texas Constitution, is amended by | ||
adding Section 35 to read as follows: | ||
Sec. 35. An agency or officer of the executive department of | ||
this state, a political subdivision of this state, or an officer of | ||
a political subdivision of this state may not prohibit the | ||
operation of an industry or other category of business or | ||
commercial activity otherwise legally operating in this state. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 2, 2021. | ||
The ballot shall be printed to permit voting for or against the | ||
proposition: "The constitutional amendment to prevent an agency or | ||
officer of the executive department of this state, a political | ||
subdivision of this state, or an officer of a political subdivision | ||
of this state from prohibiting the operation of a legally operating | ||
industry or other category of business or commercial activity in | ||
this state." |
