relating to parental rights regarding a threat assessment of a | ||
student conducted by a public school's threat assessment and safe | ||
and supportive school team. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 37.115, Education Code, is amended by | ||
adding Subsections (f-1) and (f-2) to read as follows: | ||
(f-1) Before a team may conduct a threat assessment of a | ||
student, the team must notify the parent of or person standing in | ||
parental relation to the student regarding the assessment. In | ||
conducting the assessment, the team shall provide an opportunity | ||
for the parent or person to: | ||
(1) participate in the assessment, either in person or | ||
remotely; and | ||
(2) submit to the team information regarding the | ||
student. | ||
(f-2) After completing a threat assessment of a student, the | ||
team shall provide to the parent of or person standing in parental | ||
relation to the student the team's findings and conclusions | ||
regarding the student. | ||
SECTION 2. This Act applies beginning with the 2023-2024 | ||
school year. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
