Summary

Tobacco Funds Expenditure Review Commission created. Creates the Tobacco Funds Expenditure Review Commission (the Commission) as an advisory commission to review all projects for which the Tobacco Indemnification and Community Revitalization Commission (the TICRC) anticipates that it will expend, obligate, or otherwise encumber at least $1 million. The Commission would be composed of five members of the House Committee on Appropriations, the chair, and four members appointed by the chair; three members of the Senate Committee on Finance, the chair, and two members appointed by the chair; and the Auditor of Public Accounts, who would serve with nonvoting privileges. To facilitate the work of the Commission, the TICRC would be required to provide a detailed report to the Commission by October 1 of each year listing all projects of at least $1 million that the TICRC plans to undertake in the following year. The Commission would have 10 days upon receipt of the report to determine which, if any, projects to review and would notify the TICRC of the same. For projects selected for review, the Commission would have 45 days from receipt of the report to issue any findings and recommendations. Findings and recommendations would require an affirmative vote of at least three members from the House Committee on Appropriations and two members from the Senate Committee on Finance. The bill prohibits the TICRC from undertaking or committing to undertake any project included on the annual report (i) unless it is notified by the Commission that the project will not be reviewed or (ii) until the expiration of the 45-day review period. The bill also prohibits the TICRC from promising, negotiating, or pledging any funds from the state treasury to any project, with the exception of moneys deposited into the Tobacco Indemnification and Community Revitalization Fund, unless the General Assembly has appropriated such funds to the project.
