AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the Senate Committee on Agriculture, Conservation and Natural Resources
on February 1, 2010)
(Patrons Prior to Substitute--Senators Wagner, Hanger [SB 677], Watkins [SB 245], and Whipple [SB 681])
A BILL to amend and reenact the second enactment of Chapter 18 of the Acts of Assembly of 2009, relating to stormwater management regulations.

Be it enacted by the General Assembly of Virginia:

1. That the second enactment of Chapter 18 of the Acts of Assembly of 2009 is amended and reenacted as follows:

That the regulation that establishes local program criteria and delegation procedures and the water quality and water quantity criteria, and that is referenced in subsections A and B of §10.1-603.3 of this act, shall not become effective prior to July 1, 2010 within 280 days after the establishment by the United States Environmental Protection Agency of a Chesapeake Bay-wide Total Maximum Daily Load (TMDL) but in any event no later than December 1, 2011. The Virginia Soil and Water Conservation Board shall conform the regulation to be consistent with this effective date.
