Florida Senate - 2022 SB 1080 By Senator Baxley 12-01157-22 20221080__ 1 A bill to be entitled 2 An act relating to Medicaid managed care specialty 3 plans; amending s. 409.977, F.S.; authorizing Medicaid 4 managed care specialty plans to continue serving 5 certain children whose guardians receive guardianship 6 assistance payments under the Guardianship Assistance 7 Program; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsection (5) of section 409.977, Florida 12 Statutes, is amended to read: 13 409.977 Enrollment.— 14 (5) A specialty planplansserving a childchildrenin the 15 care and custody of the department may continue to serve such 16 childchildrenas long as he or she continues to be eligible for 17 Medicaid pursuant to s. 409.903 and: 18 (a) RemainsThey remainin care, includingthoseremaining 19 in extended foster care pursuant to s. 39.6251; 20 (b) Is, or arein subsidized adoption; or 21 (c) His or her guardian receives guardianship assistance 22 payments as defined in s. 39.01 under the Guardianship 23 Assistance Programand continue to be eligible for Medicaid24pursuant to s. 409.903. 25 Section 2. This act shall take effect July 1, 2022.
