A BILL FOR AN ACT

 

 

relating to the department of health.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Hawaiian is one of the official languages of the State of Hawaii.  The legislature finds that the department of health received funding for the modernization and automation of the vital statistics system of this State.  However, members of the community have expressed concern that the department of health takes a longer time to process vital records of Hawaiian names due to their length and punctuation.  The legislature finds that all members of the community deserve to have their vital records accurately and timely processed.  Thus, the purpose of this Act is to require the department of health to issue certificates of birth, marriage, divorce, or death containing Hawaiian names as accurately and within the same time frame as certificates containing names that are not in the Hawaiian language.

     SECTION 2.  Chapter 338, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§338-    Certificates; Hawaiian and other languages.  (a)  Certificates of birth, marriage, divorce, or death issued by the department of health that contain Hawaiian names shall contain proper diacritical marks and shall be issued within the same time frame as certificates that contain names that are not in the Hawaiian language.

     (b)  The department of health may adopt rules pursuant to chapter 91 to effectuate this section."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2013.
