A BILL FOR AN ACT

 

 

relating to transportation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the construction of a shared-use (bicycle and pedestrian) pathway along Kahekili highway between East Hui Iwa street and Waihee road would improve the quality of life of Kahaluu residents by helping to promote healthy lifestyles and providing safe, environmentally friendly, non-motor vehicle travel options for residents to commute to nearby parks, schools, and convenience stores.

     SECTION 2.  (a)  The department of transportation shall plan, design, and construct a shared-use pathway along the mauka side of Kahekili highway stretching between East Hui Iwa street and Waihee road that allows for two-directional bicycle and pedestrian traffic.  The department's plan shall include at least the following:

     (1)  A description of the geographic area affected by the planned construction;

     (2)  Estimated total cost of the project;

     (3)  Estimated timeline of the project; and

     (4)  Any other relevant items deemed appropriate or necessary by the director of transportation.

     (b)  The department of transportation shall begin construction of the shared-use pathway no later than           .

     (c)  The director of transportation shall report annually on the progress of the construction project, including findings, recommendations, and any necessary proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2014 and each regular session thereafter until completion of the project.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $1,500,000 or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for plans, design, and construction of a shared-use pathway along the mauka side of Kahekili highway stretching between East Hui Iwa street and Waihee road that allows for two-directional bicycle and pedestrian traffic.

     The sums appropriated shall be expended by the department of transportation for the purposes of this Act.

     SECTION 4.  This Act shall take effect upon its approval; provided that section 3 shall take effect on July 1, 2013.
