Bill Title: Amends the School Code. Requires a public school to permit a student, without the authorization of the student's parent or legal guardian or a physician, to possess or self-apply sunscreen that is regulated by the U.S. Food and Drug Administration. Provides that if a student is unable to self-apply sunscreen, a volunteer school employee may apply the sunscreen on the student if the student's parent or legal guardian provides written consent for the assistance. Sets forth provisions concerning liability. Effective immediately.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The School Code is amended by adding Sections | |||||||||||||||||||||
5 | 10-20.67 and 34-18.60 as follows:

6 | (105 ILCS 5/10-20.67 new) | |||||||||||||||||||||
7 | Sec. 10-20.67. Sunscreen permitted. | |||||||||||||||||||||
8 | (a) As used in this Section: | |||||||||||||||||||||
9 | "Sunscreen" means a compound topically applied to prevent | |||||||||||||||||||||
10 | sunburn. | |||||||||||||||||||||
11 | "Volunteer school employee" means an employee of a school | |||||||||||||||||||||
12 | district that voluntarily offers to apply sunscreen in | |||||||||||||||||||||
13 | accordance with subsection (c) of this Section. | |||||||||||||||||||||
14 | (b) A public school shall permit a student, without the | |||||||||||||||||||||
15 | authorization of the student's parent or legal guardian or a | |||||||||||||||||||||
16 | physician, to possess or self-apply sunscreen that is regulated | |||||||||||||||||||||
17 | by the U.S. Food and Drug Administration. | |||||||||||||||||||||
18 | (c) If a student is unable to self-apply sunscreen, a | |||||||||||||||||||||
19 | volunteer school employee may
apply the sunscreen on the | |||||||||||||||||||||
20 | student if the student's parent or legal guardian provides | |||||||||||||||||||||
21 | written
consent for the assistance. | |||||||||||||||||||||
22 | (d) A volunteer school employee who applies sunscreen on a | |||||||||||||||||||||
23 | student in accordance
with subsection (c) of this Section and |

2 | are not liable for: | ||||||
3 | (1) an adverse reaction suffered by the student as a | ||||||
4 | result of having the sunscreen applied; or | ||||||
5 | (2) discontinuing the application of the sunscreen at | ||||||
6 | any time.
