AN ACT concerning local government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Counties Code is amended by adding Sections
3-6041 and 11-1-14 as follows:
(55 ILCS 5/3-6041 new)
Sec. 3-6041. Mental health services. The sheriff of each
county shall provide mental health services to all deputies
employed by the county. A home rule unit may not regulate
mental health services in a manner inconsistent with this
Section. This Section is a limitation under subsection (i) of
Section 6 of Article VII of the Illinois Constitution on the
concurrent exercise by home rule units of powers and functions
exercised by the State.

Sec. 11-1-14. Mental health services. The corporate
authorities of each municipality shall provide mental health
services to all police officers employed by the municipality. A
home rule unit may not regulate mental health services in a
manner inconsistent with this Section. This Section is a

Section 90. The State Mandates Act is amended by adding
Section 8.40 as follows:

Sec. 8.40. Exempt mandate. Notwithstanding Sections 6 and 8
of this Act, no reimbursement by the State is required for the
implementation of any mandate created by this amendatory Act of
the 99th General Assembly.
