JOINT RESOLUTION

Submitting to the qualified voters of Missouri an amendment repealing section 17 of article IV of the Constitution of Missouri and adopting one new section in lieu thereof relating to the election of statewide officials.




Be it resolved by the House of Representatives, the Senate concurring therein:


            That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 2014, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article IV of the Constitution of the state of Missouri:

            Section A. Section 17, article IV, Constitution of Missouri, is repealed and one new section adopted in lieu thereof, to be known as section 17, to read as follows:

            Section 17. The governor, lieutenant governor[, secretary of state, state treasurer] and attorney general shall be elected at the presidential elections for terms of four years each. The secretary of state, state auditor and state treasurer shall be elected for a term of two years at the general election in the year [1948] 2016, and his or her successors shall be elected for terms of four years. No person shall be elected governor [or] , lieutenant governor, secretary of state, state auditor, treasurer or attorney general more than twice, and no person who has held the office of governor [or] , lieutenant governor, secretary of state, state auditor, treasurer or attorney general, or acted as governor [or] , lieutenant governor, secretary of state, state auditor, treasurer or attorney general, for more than two years of a term to which some other person was elected to the office of governor [or] , lieutenant governor, secretary of state, state auditor, treasurer or attorney general shall be elected to the office of governor [or] , lieutenant governor, secretary of state, state auditor, treasurer or attorney general more than once. The heads of all the executive departments shall be appointed by the governor, by and with the advice and consent of the senate. All appointive officers may be removed by the governor and shall possess the qualifications required by this constitution or by law.

            Section B. Pursuant to chapter 116, RSMo, and other applicable constitutional provisions and laws of this state allowing the general assembly to adopt ballot language for the submission of this joint resolution to the voters of this state, the official summary statement of this resolution shall be as follows:

            “Shall the Missouri Constitution be amended to impose a two-term limit for all statewide elected officials and hold elections for the offices of secretary of state and state treasurer in 2016 and every four years thereafter?”
