AN ACT

Amending Title 24 (Education) of the Pennsylvania Consolidated

2

Statutes, further providing for the definition of

3

"governmental entity" and for the Public School Employees'

4

Retirement Board; and providing for a lump sum payment to

5

employees of the Pennsylvania School Boards Association of

6

the accrued value of their retirement benefits.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  The definition of "governmental entity" in

10

section 8102 of Title 24 of the Pennsylvania Consolidated

11

Statutes is amended to read:

§ 8102.  Definitions.

13

The following words and phrases when used in this part shall

14

have, unless the context clearly indicates otherwise, the

15

meanings given to them in this section:

"Governmental entity."  Board of school directors, board of

18

public education, intermediate unit board of directors, area

19

vocational-technical board, any governing board of any agency or

20

authority created by them, and the Commonwealth. The term shall

exclude the Pennsylvania School Boards Association and its

2

employees.

Section 2.  Section 8501(a) of Title 24 is amended to read:

5

§ 8501.  Public School Employees' Retirement Board.

(a)  Status and membership.--The board shall be an

7

independent administrative board and shall consist of 15

8

members: the Secretary of Education, ex officio; the State

9

Treasurer, ex officio; two Senators; two members of the House of

10

Representatives; [the executive secretary of the Pennsylvania

11

School Boards Association, ex officio;] two to be appointed by

12

the Governor, at least one of whom shall not be a school

13

employee or an officer or employee of the State; three to be

14

elected by the active professional members of the system from

15

among their number; one to be elected by annuitants from among

16

their number; one to be elected by the active nonprofessional

17

members of the system from among their number; and [one] two to

18

be elected by members of Pennsylvania public school boards from

19

among their number. The appointments made by the Governor shall

20

be confirmed by the Senate and each election shall be conducted

21

in a manner approved by the board. The terms of the appointed

22

and nonlegislative elected members shall be three years. The

23

members from the Senate shall be appointed by the President pro

24

tempore of the Senate and shall consist of one member from the

25

majority and one member from the minority. The members from the

26

House of Representatives shall be appointed by the Speaker of

27

the House of Representatives and shall consist of one member

28

from the majority and one member from the minority. The

29

legislative members shall serve on the board for the duration of

30

their legislative terms and shall continue to serve until 30

days after the convening of the next regular session of the

2

General Assembly after the expiration of their respective

3

legislative terms or until a successor is appointed for the new

4

term, whichever occurs first. The chairman of the board shall be

5

elected by the board members. Each ex officio member of the

6

board and each legislative member of the board may appoint a

7

duly authorized designee to act in his stead.

Section 3.  Employees of the Pennsylvania School Boards

10

Association who were members of the Public School Employees'

11

Retirement System before the effective date of this section

12

shall be entitled to receive, in a lump sum payment, the present

13

value of their benefit accrued to the effective date of this

14

section. The Public School Employees' Retirement Board shall

15

make payment to the employees within 90 days of the effective

16

date of this section.

Section 4.  This act shall take effect July 1, 2009, or

18

immediately, whichever is later.
