| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in pupils and attendance, further |
6 | providing for costs of tuition and maintenance of certain |
7 | exceptional children in approved institutions. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. Section 1376 of the act of March 10, 1949 |
11 | (P.L.30, No.14), known as the Public School Code of 1949, |
12 | amended July 4, 2004 (P.L.536, No.70), is amended by adding a | <-- |
13 | subsection to read: |
14 | Section 1376. Cost of Tuition and Maintenance of Certain |
15 | Exceptional Children in Approved Institutions.--* * * |
16 | (c.9) (1) The Department of Eduction Education shall | <-- |
17 | approve an application to be an approved private school if the |
18 | applicant: |
19 | (i) Meets the regulatory requirements for application per 22 | <-- |
20 | Pa. Code Ch. 171 (relating to standards for approved private |

1 | schools). |
2 | (1) (ii) Is an auditory-oral school for the deaf. | <-- |
3 | (2) (iii) Is a member of the national organization of | <-- |
4 | schools that advances listening and spoken language education |
5 | for children with hearing loss. |
6 | (3) (iv) Has at least three faculty members who are | <-- |
7 | listening and spoken language specialists as certified by the |
8 | Alexander Graham Bell Association for the Deaf. |
9 | (4) (v) Demonstrates, through independent verification, that | <-- |
10 | the applicant is compliant with all content areas or test |
11 | domains examined by the Alexander Graham Bell Association for |
12 | the Deaf. |
13 | (2) An approved private school under this subsection is | <-- |
14 | eligible to receive State payments under this section only to |
15 | the extent that funds are appropriated for approved private |
16 | schools by the General Assembly for fiscal year 2010-2011 in an |
17 | amount greater than that appropriated for the 2009-2010 fiscal |
18 | year. |

20 | Section 2. Any and all regulations are abrogated to the |
21 | extent of any inconsistency with this act. |
22 | Section 3. This act shall take effect in 60 days. |
