AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

Statutes, further providing for the offense of accidents

3

involving death or personal injury.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 3742(b)(2) and (3) of Title 75 of the

7

Pennsylvania Consolidated Statutes are amended to read:

8

§ 3742.  Accidents involving death or personal injury.

(b)  Penalties.--

(2)  If the victim suffers serious bodily injury, any

13

person violating subsection (a) commits a felony of the third

14

degree, and the sentencing court shall order the person to

15

serve a minimum term of imprisonment of not less than [90

16

days] one year and a mandatory minimum fine of [$1,000]

17

$10,000, notwithstanding any other provision of law.

(3)  If the victim dies, any person violating subsection

 


1

(a) commits a felony of the third degree, and the sentencing

2

court shall order the person to serve a minimum term of

3

imprisonment of not less than [one year] two years and a

4

mandatory minimum fine of [$2,500] $20,000, notwithstanding

5

any other provision of law.

Section 2.  This act shall take effect in 60 days.
