AN ACT

Amending the act of July 9, 1990 (P.L.340, No.78), entitled "An

2

act providing for a Statewide emergency telephone number 911

3

system; providing for contributions from telephone

4

subscribers; providing a penalty; and making a repeal,"

5

further providing for expenditures for nonrecurring costs,

6

training, mobile communications equipment, maintenance and

7

operation of 911 systems, and for disbursement of fund

8

amounts by agency.

The General Assembly of the Commonwealth of Pennsylvania

10

hereby enacts as follows:

Section 1.  Section 8(b) of the act of July 9, 1990 (P.L.340,

12

No.78), known as the Public Safety Emergency Telephone Act,

13

amended February 12, 1998 (P.L.64, No.17), is amended to read:

14

Section 8.  Expenditures for nonrecurring costs, training,

15

mobile communications equipment, maintenance and

16

operation of 911 systems.

(b)  Items included in nonrecurring costs, training, mobile

19

communications equipment, maintenance and operation costs.--

20

Maintenance and operation costs may include telephone company

21

charges, equipment costs or equipment lease charges, repairs,

utilities, development and maintenance of a master street

2

address guide, erection of street signs on State and local

3

highways, data base maintenance costs, personnel training,

4

salary and benefit costs which are directly related to the

5

provision of 911 services and costs for mobile communications

6

equipment, audit costs and appropriate carryover costs from

7

previous years. Maintenance and operation costs shall not

8

include any cost necessary to house the 911 system. No more than

9

[70%] 80% of the contribution rate collected during each

10

county's fiscal year may be utilized to fund personnel training,

11

salary and benefit costs.

Section 2.  Section 11.5(b) of the act, added December 30,

14

2003 (P.L.384, No.56), is amended to read:

15

Section 11.5.  Disbursement of fund amounts by agency.

(b)  Limitations on use of fund amounts by PSAPs.--No PSAP

18

shall receive a disbursement from the fund for any cost

19

necessary to house the wireless E-911 system or for the purchase

20

of real estate, cosmetic remodeling, ambulances, fire engines or

21

other emergency vehicles, utilities, taxes and other expenses as

22

determined by the agency. No more than [70%] 80% of the

23

disbursements which a PSAP receives from the fund during the

24

agency's fiscal year may be utilized to fund personnel training,

25

salary and benefit costs.

Section 3.  This act shall take effect in 60 days.
